GENERAL CONDITIONS OF CONTRACT
This website www.farsens.com is owned and operated by FARSENS, S.L. with Tax Code B20983383 / VAT identification number ESB20983383 and registered office at Paseo Mikeletegi, 54 – 20009 San Sebastian – Spain operating under the commercial trademark FARSENS.
These General Contractual Terms and Conditions serve to regulate the remote sales relationship between FARSENS, S.L. and the user or customer, pursuant to legal stipulations, particularly Law 7/1998 of 13 April, on General Contractual Conditions, Law 3/2014 of 27 March, whereby the consolidated text of the General Law for the Protection of Consumers and Users is amended, current and applicable Regulations on Personal Data Protection, Law 7/1996 of 15 January, on the Organisation of Retail Trade, and Law 34/2002 of 11 July, on the Information Society Services and Electronic Commerce.
FARSENS, S.L. reserves the right to make any modification as they may deem necessary to these General Terms and Conditions, without prior notification. Such modifications may be made via their websites, in any legally admissible way, and compliance therewith will be mandatory throughout the time they are published on the web and until they have been validly changed, by means of subsequent modifications. Nevertheless, FARSENS, S.L. reserves the right to apply, in certain cases, Particular Contractual Terms and Conditions with preference over the present General Terms and Conditions, whenever they consider to be suitable, announcing them at any time and in any way that they judge to be expedient.
The purpose of the website is the sale of FARSENS’s products that include integrated circuits and evaluation kits.
The contract period will be linked to the delivery of the product, without prejudice to the right of withdrawal.
Likewise, you can subscribe to the newsletter and stay updated on the latest developments and special offers of products.
As the user, or customer, you expressly declare that you know, understand and accept the conditions of use and the present General Contractual Terms and Conditions. In the same way, you also declare to be of legal age and have the necessary legal capacity and competence to access the FARSENS, S.L. website and enter into contract therein.

The user registration is an essential requirement to order products online. You can access the registration section on the website itself. Pursuant to the current and applicable Regulations on Personal Data Protection, FARSENS, S.L. informs users that the personal data gathered during the registration process and subsequent purchase order process will be entered into a file under their responsibility, with the aim of processing aforementioned actions made by the user and managing operations derived therefrom. FARSENS, S.L. likewise informs of the possibility of exercising access, rectification, cancellation and objection rights by sending the request to Paseo Mikeletegi, 54 – 20009 San Sebastian – Spain or through the email address firstname.lastname@example.org.

You become responsible for confidentially and responsibly handling the identity and password obtained when registering as a client and may not transfer them to another person. Once the purchasing process has been completed, customers will receive confirmation by email. It is essential that, at some point during the purchasing process, users provide a valid email address. The estimated delivery time will be communicated via email whithin 2 working days once the payment of the order has been validated.

Customers, on receiving delivery of the product at the established address, will also be provided with the delivery note of the order.

In compliance with current regulations FARSENS, S.L. provides information, characteristics and prices on all articles for sale from their website. Nevertheless, FARSENS, S.L. reserves the right to withdraw, replace or change products offered on the website by simply changing the contents of that site. In this way, the available products on the web at any given time will be governed by the General Contractual Terms and Conditions in force in each case. Moreover, the company will have the right to cease to offer access to the aforementioned products at any time with no prior notice.
Essential characteristics of the products
The products on sale on the webpage are displayed together with a picture and their essential characteristics. This information has been obtained from the manufacturer. The color of the product shown in the photographs is not binding.
FARSENS, S.L. responds to the lack of conformity of all products offered on the website for a two-year period from delivery. FARSENS, S.L. provides an after-sales service, and while the product warranty is valid the customer will be able to execute it by heading for the establishment of FARSENS, S.L., the after-sales service, by sending an email to firstname.lastname@example.org, or at places established by the provider. The products indicate the sale price in Euros, without including Value Added Tax (VAT).
If applicable, any other taxes will also be indicated.
In accordance with the provisions of the current legislation on Personal Data Protection, FARSENS, S.L. hereby informs that the personal data will be incorporated into the processing system owned by FARSENS, S.L., in order to facilitate, attend to and meet the commitments established between the two parties.
In accordance with the rights conferred on the customer by the current legislation on Personal Data Protection, the rights of access, rectification, limitation of processing, deletion, portability and opposition may be exercised by sending the request to the postal address Paseo Mikeletegi, 54 – 20009 San Sebastian – Spain.
Unless otherwise stated within 30 days, FARSENS, S.L. will understand that the provided data has not been modified, that notification of any change will be received and that we have the consent to use the data in order to process the billing.
FARSENS, S.L. hereby informs that the granted consent to receive electronic invoices can be revoked by sending an email to the following address: firstname.lastname@example.org.
Delivery and transport costs
FARSENS, S.L. arranges shipments worldwide, charging different amounts for shipping costs that may vary depending on the destination and weight of the package. Customer will be able to visualize this concept before formalizing the payment.
Those orders for any country outside of the European Union are likely to be charged customs duties. Customs taxes at destination will be at the recipient’s expense. FARSENS, S.L. recommends to check customs duties and fees levied by the destination country before placing the order. No refunds or changes will be accepted in the case of placing the order and finally not supporting the customs expenses thereof originated.
Payment methods and order processing
Customers can pay the amount of the order by choosing any of the following ways. Payment method should be specified during the purchase process.
When selecting bank transfer as a payment method, an email message with the bank details of FARSENS, S.L. will be sent along with the order confirmation.
It is important to indicate the order number in the subject of the wire transfer together with the full name. The transfer should be made within 3 working days after the confirmation date to validate it.
The transfer receipt can be provided by email at email@example.com as a proof of payment. Either way, the order will not start to be processed until our administration department receive the transfer confirmation from the bank.
Customer must remind that payment must be made in EUROS and any currency exchange fees and bank charges should be borne by buyer.
For bank transfers made from outside Spain, it is extremely important to inform the bank that the sender should take care of commissions at origin, such as any bank commissions or charges corresponding to the entity. Otherwise, FARSENS, S.L. could retain the shipment due to not having received the full amount required.
Any currency exchange fees and other bank commissions shall be borne by buyer.
Paypal enables online payments to be made safely and conveniently. PayPal network is based on the existing financial infrastructure of bank accounts and credit cards in order to set up a real-time global payment solution. Paypal provides a service that is specifically designed for those who are not satisfied with traditional payment mechanisms.

FARSENS, S.L. informs that estimated lead times detailed below are based on the date of dispatch and on deliveries to capital cities. For this reason, it is requested to allow extra time for deliveries to regional and remote areas.

To most important cities in USA: 3 working days
To most important cities in Latin America: 4 working days
To most important cities in Asia and Oceania: 5 working days
To Africa and Oceania: 5 working days
The aforementioned delivery times are just indicative due to unexpected delays that could occur with customs procedures or other reasons beyond FARSENS, S.L.’s control.
FARSENS, S.L. works with FedEx for international shipping and Tourline Express for shipments within Spain.
The availability of products offered by FARSENS, S.L. may vary depending on customer demand. Although FARSENS, S.L. updates the stock on a regular basis it could be depleted at that time. In the event of non-execution due to unavailability, FARSENS, S.L. will notify users via email as soon as FARSENS, S.L. becomes aware of the situation. This notification will be sent no later than 30 days after the order has been placed. FARSENS, S.L. may then offer the double option of supplying the customer with a product of similar or superior characteristics without increasing the price, or excepting reasonable and provable grounds that can be justified by FARSENS, S.L. within this same period, reimbursing the amounts paid for the cancelled order. Should this payment not be made within the specified period, the buyer may claim to be paid twice the amount owed, without prejudice to the right to be indemnified.
Right of rejection, returns and claims
Customer will have a minimum period of fourteen calendar days to reject the order, from the day the product has been received, with no penalty and without providing a reason.
The exercise of the right of rejection must be carried out by notification through telephone communication by contacting FARSENS, S.L. at +34943308013, via email at firstname.lastname@example.org, by sending a letter addressed to Paseo Mikeletegi, 54 – 20009 San Sebastian – Spain or through the rejection form.
Pursuant to Article 103 of Spanish Law 3/2014, of 27th March, modifying the consolidated text of the Spanish General Law for the Protection of Consumers and Users, supplies of services or goods prepared in accordance with the consumer’s specifications or clearly customised, or which, by their nature, cannot be returned or may rapidly deteriorate or exceed their sell-by date, are exempted from the right to rejection.
The customer must return or deliver the product directly to FARSENS, S.L., to the address Paseo Mikeletegi, 54 -20009 San Sebastian, Spain, without undue delay and within fourteen calendar days from the date on which the right of rejection is formalized. It will consider the deadline fulfilled if the customer makes the return of the product before the end of the term.
Customer must bear the costs of returning the product.
The returned products must be in perfect conditions, unused and in their original packaging. FARSENS, S.L. strongly requests to ensure that the package is properly protected and sealed in order to avoid transport issues. Once received, we will check the status. As soon as FARSENS, S.L. verifies that the article and the possible components, accessories, promotional gifts and documentation are complete and in perfect condition, the amount paid will be refunded.
The refunding of the amounts received by customer will be made using the same means of payment employed during the purchase process, unless the contrary has been stipulated.
FARSENS, S.L. may withhold the refund until the rejected product has been received.
In case of unjustified delay on part of FARSENS, S.L. with respect to the refund of sums paid, customer may claim to be paid twice the amount owed, without prejudice to the right to be indemnified for the damage sustained that exceed the aforementioned amount.
Return of faulty goods
In the event that the product is not in good conditions and the damage arises from a cause not attributable to the customer, customer will be entitled to return the product informing FARSENS, S.L. the reason for return via any of the means provided in these General Contractual Terms and Conditions at no extra cost. Returns due to imperfections or faulty products will not be considered a right of rejection.
FARSENS, S.L. undertakes to bear the cost of the return and to replace the faulty product for a brand new product, in accordance with the conditions accepted at the time of sale.

FARSENS, S.L. reserves the right to file civil or criminal actions its deems appropriate for the misuse of the website and content, or for the breach of these conditions.
The relationship between user and provider will be governed by the current legislation enforced in Spanish territory. Should any dispute arise, the parties may submit their disagreement to arbitration or to the ordinary courts, in compliance with the rules of juridisction and authority in this regard.
